This notice explains how PEERS advokátní kancelář, s.r.o. processes personal data relating to visitors to www.pravoprosmenarny.cz, prospective clients, contact persons of clients and other individuals who communicate with us through the website.

For this website, enquiries and our own legal services, PEERS generally acts as controller. We act as processor only where we process data on behalf of another controller under a specific arrangement; this must not be stated as a universal role for all website users.

2. Data we process

Depending on how you use the website, we may process:

Contact form and communication data

  • name and surname;
  • job title and organisation, if provided;
  • email address and telephone number;
  • the content of the message and attachments;
  • date, time and technical submission data.

Data relating to a potential legal engagement

  • identity and contact details;
  • information necessary to assess the matter, perform conflict checks, prepare a proposal and enter into an engagement;
  • information about other persons involved;
  • information required by law, including AML information where applicable to the particular service.

Technical and security data

  • IP address;
  • request date and time;
  • URL visited;
  • browser and device type;
  • system and security logs.

Analytics and marketing data

Only after the relevant consent may we process online identifiers and information about visits, traffic sources and website interactions through analytics or marketing tools. The contact form must not disclose the user's name, email, telephone number or message to analytics or advertising services without a separate valid marketing consent. Under the technical specification below, personal data from the form are not sent to measurement tools even in hashed form.

3. Purposes and legal bases

Responding to an enquiry and pre-contractual steps

We process data to answer an enquiry, assess whether we can accept the matter, perform conflict checks and prepare a proposal. The legal basis is taking steps at the data subject's request prior to entering into a contract and, where necessary, our legitimate interest in managing and documenting enquiries.

Legal services

Once a matter has been accepted, we process data to perform the engagement, comply with an advocate's legal duties, protect the client's rights and establish, exercise or defend legal claims. Additional information may be provided in a client-specific privacy notice.

Legal obligations

We process data where required by legislation, including rules on the legal profession, accounting, tax, AML and duties towards public authorities.

Website security and legal claims

We process necessary technical logs based on our legitimate interests in website security, prevention of misuse, incident response and protection of legal claims.

Analytics and marketing

Non-essential analytics and marketing tools are used only on the basis of consent. Consent may be changed or withdrawn at any time through the Cookie settings link in the footer. Withdrawal does not affect the lawfulness of processing before withdrawal.

Legal updates and commercial communications

Where you subscribe separately, we process your email address and the consent record to send legal updates. Existing clients may receive communications concerning similar services where permitted by law, always with a simple opt-out.

4. Is provision of data mandatory?

Providing data through the contact form is voluntary. Without basic contact details and a description of the matter, however, we may be unable to respond.

Do not send special categories of personal data, criminal-offence data or sensitive documents through the initial form unless they are necessary for a preliminary assessment. A more secure channel may be agreed for further communication.

5. Retention

We retain data only for as long as necessary for the relevant purpose:

  • an ordinary enquiry that does not lead to an engagement: generally no more than 12 months after the last communication;
  • a record required to document a conflict check or refusal of a matter: for the period necessary to protect rights and comply with professional duties;
  • client files: during the engagement and thereafter for the period required by law, professional rules or the protection of legal claims;
  • accounting and tax records: for the applicable statutory periods;
  • AML records, where applicable: for the period required by the AML legislation;
  • security logs: generally no more than 90 days, unless required for an incident or legal claim;
  • analytics user and event data: no more than 14 months in the analytics tool settings;
  • consent records: for the duration of the consent and a proportionate period afterwards to demonstrate that it was obtained, generally no more than three years;
  • marketing contacts: until consent is withdrawn or communications are rejected.

Where a dispute, inspection or other proceeding arises, relevant data may be kept for the duration of that matter and the associated limitation or retention periods.

6. Recipients

Data may be processed, to the necessary extent, by:

  • hosting, technical administration and security providers;
  • email, office and data service providers;
  • external IT or web suppliers bound by confidentiality;
  • analytics or advertising providers only after the relevant consent;
  • accounting, tax or other professional advisers bound by confidentiality;
  • public authorities, courts, the Czech Bar Association or other entities where required by law or necessary to protect rights.

We do not sell personal data.

7. Transfers outside the EEA

Some technology providers may process data outside the European Economic Area. Any transfer is carried out only where the GDPR conditions are met, for example under a valid adequacy decision, standard contractual clauses and any necessary supplementary safeguards.

Use of analytics or marketing services that may involve such transfers is subject to the relevant consent.

8. Your rights

Subject to the conditions of the GDPR, you have the right to:

  • obtain confirmation of processing and access your personal data;
  • correct inaccurate and complete incomplete data;
  • request erasure where the statutory conditions are met;
  • request restriction of processing;
  • object to processing based on legitimate interests;
  • receive data in a portable format where the processing is automated, based on consent or contract and the other conditions are met;
  • withdraw consent at any time;
  • lodge a complaint with the Czech Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Prague 7, Czech Republic, www.uoou.gov.cz.

These rights are not absolute. Legal professional privilege, the rights of others, statutory retention duties and the defence of legal claims may affect how a request is handled.

We respond without undue delay and within the statutory time limits. No fee is charged unless a request is manifestly unfounded or excessive, in particular because it is repetitive, in which case we act only within the limits permitted by the GDPR.

9. Automated decision-making

We do not use data obtained through this website for solely automated decision-making that produces legal or similarly significant effects.

10. Security

We use appropriate technical and organisational measures, including encrypted transmission, access controls, backups, system updates and confidentiality obligations.

11. Changes

We may update this notice when the website, suppliers or legal requirements change. The current version is published on this page with the date of the latest update. A material change in purpose or legal basis will be addressed by an appropriate notice and, where required, a new consent.

12. Contact

Privacy requests and questions may be sent to matyas.moska@peers.law. We may reasonably verify the requester's identity to protect the data concerned.
